New form of declaration of conformity of working conditions in 2026
Since 2026, employers continue to use the declaration of compliance of working conditions with state regulatory labor protection requirements when declaring the results of a special assessment of working conditions (SOUT). The declaration is submitted in relation to workplaces where, based on the results of the assessment and safety assessment, no harmful and (or) hazardous production factors have been identified or working conditions have been recognized as optimal or acceptable (class 1 or 2).
On the basis of which document is the declaration submitted?
The form of the declaration and the procedure for its submission were approved by order of the Ministry of Labor of Russia dated June 17, 2021 No. 406n. It is this document that is valid in 2026 and defines the requirements for filling out, submitting and maintaining the register of declarations.
Who is required to file a declaration
The declaration is submitted by all employers who, according to the results of the Special Labor Assessment, have jobs with optimal or acceptable working conditions. The declaration includes information about positions, individual job numbers and the number of workers employed in these places.
Deadline for filing a declaration
The employer is obliged to submit a declaration no later than 30 working days from the date of entering information about the results of the special assessment of working conditions into the Federal State Information System for recording the results of a special assessment of working conditions (FSIS SOUT).
How to submit a declaration
You can submit a declaration in several ways:
- in person to the territorial state labor inspectorate;
- send by registered mail with a list of the contents and notification of delivery;
- in electronic form through the Rostrud service using an enhanced qualified electronic signature.
Electronic filing is the most convenient method, since it allows you to automatically register a document in the declaration register.
What information is indicated in the declaration
When filling out the document you must indicate:
- full name of the employer;
- TIN and OGRN of the organization;
- legal address;
- information about jobs;
- names of professions and positions of employees;
- individual workplace numbers;
- data from the organization that conducted the special assessment;
- details of the expert opinion.
Validity period of the declaration
Currently, the declaration is valid indefinitely. Repeated declaration is not required if working conditions have not changed at the workplace, no industrial accidents have occurred and no occupational diseases of workers have been identified.
Responsibility for failure to submit a declaration
Failure to submit a declaration may be regarded as a violation of labor protection requirements. For such violations, administrative liability is provided under Article 5.27.1 of the Code of Administrative Offenses of the Russian Federation. The fine for legal entities can reach 80,000 rubles, and for repeated violations – much higher.
What is recommended for an employer to do?
After completing the SOUT, it is necessary to check whether the results are included in the FSIS SOUT, prepare a declaration in the prescribed form and send it within the prescribed period. It is also recommended to check the presence of an entry in the register of Rostrud declarations after registering the document.
Timely submission of the declaration allows you to confirm compliance of working conditions with state regulatory requirements and avoid claims from the State Labor Inspectorate.
