The Ministry of Labor strengthens control over labor relations with the self-employed

The Ministry of Labor has introduced a new risk indicator, which concerns the cooperation of organizations with the self-employed. The rules entered into force on January 6, 2025 (Ministry of Labor Order No. 640n dated 11/28/2024).

Now, cooperation with the self-employed will be regarded as a substitution of labor relations if the following actions are simultaneously identified:

• the customer (company or sole proprietor) interacts with more than 35 individuals or sole proprietors who use NAP;
• the average monthly income of these employees from the customer exceeds 35,000 rubles.;
• the average duration of cooperation with the customer is more than three months.;
• the share of income from this customer is 90% or more of the total income of the contractor.
